Commentary: Why would anyone frame R. Kelly?

Six years after charges were filed, R&B superstar R. Kelly's future could rest on what jurors think about a mole.

NEW YORK (CNN) -- "My mind is telling me no but my body, my body's telling me yes

Well, he didn't confess. He didn't even testify at his child pornography trial. Now that R. Kelly's fate is in the jury's hands, the only real question is: Is that really R. Kelly having sex with a 13-year-old girl on the infamous tape, also known as People's Exhibit No. 1?

The monthlong trial was six years in the making. Kelly was charged in 2002 with 14 counts of videotaping himself having sex with an underage girl, who prosecutors say was as young as 13. If convicted, he faces up to 15 years in prison and would have to register as a sex offender.

The jury saw the graphic, 27-minute tape at the very beginning of the case and again at the end. Jurors took it with them into the jury room. If a picture is worth a thousand words, what about a 27-minute video?

As for the defense in the case, Kelly's attorney, Sam Adam Jr., gave jurors two ways out of convicting his R&B superstar client in his closing argument: "It ain't him." And, "It's a setup."

But countless people testified that R. Kelly is on the tape, even people who used to work for him. And many testified that the girl on the tape was in fact his 13-year-old "goddaughter," even members of her own family.

Experts testified that R. Kelly has a very big mole on his back and that a very similar looking mole is on the guy on the tape. Other experts testified that the tape was not doctored.

According to testimony, the sex acts took place in a log cabin room. And yes, R. Kelly had a log cabin room with what has been described as "distinctive blond half-log paneling" in the basement of a home he used to own.

The scene of the alleged crime was called by several different names, including the "hot tub room," the "Colorado room," and the "sauna room."

So how is it a setup and why would anyone bother? If the setup scenario is indeed true, someone went to great lengths to find an imposter that looked a lot like R. Kelly (complete with a fake back mole) having sex with a girl that looked a lot like his goddaughter, in a room that looked a lot like one he owned.

And why?

Well, the defense claims that "from the beginning to the end this is about money." Hmmm. Really? What money? How much? Who tried to get the money? Did they get it? I don't think these questions were really answered.

Will the jury think there is something wrong with R. Kelly bumping and grinding with a 13-year-old?? We will know shortly.
