11th Circuit Court of Appeals Reaches Decision in Elian Gonzalez Case

LOU WATERS, CNN ANCHOR: CNN has learned there will be an order within this hour from the 11th Circuit Court of Appeals in the Elian Gonzalez case. That's according to the court clerk. It should happen within moments, the fact that it will be announced. And we'll bring that to you.

In the meantime, let's check in with Mark Potter, CNN correspondent who's down there in Little Havana in front of the home of Lazaro Gonzalez, who has a development from there -- Mark.

MARK POTTER, CNN CORRESPONDENT: Hello, Lou.

Well, the word is starting to filter out here that there will be an order from the court within an hour. The family spokesman, Armando Gutierrez, just told me that he is now rushing to one of the attorneys' offices to receive the word. And once they get it, they will place a phone call here to the house in Little Havana where Lazaro Gonzalez and his family have been caring for Elian Gonzalez. They will then tell them what the court order is.

We have no idea, of course, what the court is going to say. Everyone here is waiting. But the word has gotten here and the family will be waiting for that word.

This is something that people here have been anticipating for several days. They have been very nervous about it. You can tell that the protesters, the small -- relatively small crowd of protesters here, are concerned about it. They have been rather subdued, certainly not joyous in their activities in the last few days, just waiting to see.

A police yesterday described the scene as what you might expect at a doctor's office where people are waiting for the physician to come back with the news, news that might be bad news.

Again, in saying that, I am not suggesting that we have any idea what the court is going to rule, but certainly I can say with great certainty that the people here are very nervous about it, have been waiting all along for this.

This is the big story. There was the fight yesterday over the psychological letter and the arguments there, but that was all occurring, I think, and grew to the degree that it did because the real story hadn't happened yet. And this is it. Many people here feel that this could have an important if not defining effect on this case. And so this is the big news that everyone is waiting for.

WATERS: Mark, was there not also another lawsuit filed based on human rights of Cuba, which is now on hold pending this decision by the 11th Circuit?

POTTER: That's exactly it. It is on hold. It's a civil suit that was filed in Washington, D.C. claiming that Elian should not be sent back to Cuba on the grounds that it would violate his human rights because Cuba, according to the lawsuit, is out of step with U.N. human rights standards, human rights regulations.

But that is not the issue at hand. All eyes now are on Atlanta and the 11th Circuit Court of Appeals to see what the judges there have to say.

WATERS: All right, Mark Potter keeping watch down there in Little Havana. We certainly will be back to you shortly as we wait for the announcement of the decision by the 11th Circuit here in Atlanta on the custody of Elian Gonzalez.
