Emergency Hearing Called in Wen Ho Lee Case

KYRA PHILLIPS, CNN ANCHOR: Our CNN TODAY "Notebook" opens the continuing investigation at the Los Alamos National Laboratory. An emergency meeting is scheduled to start shortly in a judges chambers.

We now turn to Tony Clark, who's in White Rock, New Mexico with the latest -- Tony.

TONY CLARK, CNN CORRESPONDENT: Kyra, Wen Ho Lee was expected to be released this afternoon on bail and remain under House arrest until his trial in November, but that release may be in question now. The 10th Circuit Court of Appeals in Denver has been told to expect the government to file an appeal of the judge's release order and ask for an emergency stay, although the 10th Circuit tells me they have not yet received that.

An emergency hearing has been called in Judge James Parker's courtroom. That to begin in just about 10 or 15 minutes. Attorneys will not say what the reason for that. They said that they, in fact, were not told. They were just told that there is an emergency hearing in the judge's courtroom. But it must be assumed, I think, at this point, that it deals with whether or not he would be released.

Wen Ho Lee was scheduled to be released at noon today, and so that hearing is coming just a half hour before that. What is expected is that Judge Parker may make some decision on whether or not Lee will be released this afternoon. Lee's wife and next-door neighbors left here about an hour ago to go to Albuquerque to sign the necessary papers. Dr. Lee is at the courthouse now.

And so everything was moving on track for his release today, but as I say now, Kyra, that release may be in question.
