The Florida Recount: Court Ruling on Certification Deadline Expected Noon ET

QUESTION: Any warning to get back if we need to go cover Secretary Baker across the streets at 11:00?

UNIDENTIFIED MALE: I can't tell you that, It could potentially be released in the next half hour. We really don't know. My anticipation is it will be close to noon, but I can't promise you that we will know any differently at the moment.

STAFF: Yes, the first name is Terre T-E-R-R-E.

MIKE BOETCCHER, CNN CORRESPONDENT: ... will not come until noon. And the court administrator will come down and read it then. No decision yet. No decision yet. This decision from Judge Terre Lewis will come down at noon now.

KAGAN: Michael Boettcher are you with us, can you hear me?

BOETTCHER: Yes I hear you fine.

KAGAN: So really the news coming out of Tallahassee right now is that there is no news, whereas many of us expected a decision from this judge, from Judge Lewis, as early as 10:30. They are saying now, put an hour and a half at least on the top of that.

BOETTCHER: Yes, we got an alert earlier this morning it would be more like 11:00. And now the spokesman for the court has come down to tell us that noon looks like a more realistic time, that the opinion will be filed with the court clerk's office, and then the court administer, who is standing to the right, she will read the opinion and that will be our first idea of what this opinion is.

KAGAN: OK, very good, Mike Boettcher on the scene there in Tallahassee, Florida. Once again, we were expecting that decision as early as 10 minutes from now. But right now they are saying count more on an hour and a half. The decision from Judge Lewis coming down, the circuit judge. The question before him: Should the state stick with a 5:00 p.m. deadline today when all counties must report their certified results from last week's presidential election. The judge will decide that. And the appeals will probably go on.
