Judge Extends Deadline For Starr To Justify Bookstore Subpoenas

WASHINGTON (April 10) -- Federal District Judge Norma Holloway Johnson has extended until Monday the deadline for Independent Counsel Ken Starr to explain why there is a compelling need for subpoenaed material on Monica Lewinsky's purchases from two Washington bookstores.

Holloway, who presides over the grand jury investigating the Lewinsky matter, said that absent a convincing argument, she is persuaded "the First Amendment is indeed implicated by the subpoenas."

In her memorandum order, obtained by CNN, the judge goes on to say that "the bookstores and Ms. Lewinsky have persuasively alleged a chilling effect on their First Amendment rights."

The judge says the bookstores have shown that news of Starr's subpoena has hurt sales at their stores and that she will quash the subpoenas unless the independent counsel can persuade her there is a compelling need to uphold them.
